KINETICMATH LAB IS A TACTILE MATHEMATICS PRACTICE APPLICATION. IT IS NOT A MEDICAL DEVICE, IS NOT CLINICAL DIAGNOSTIC SOFTWARE, AND DOES NOT PROVIDE PSYCHOLOGICAL, PSYCHIATRIC, NEUROLOGICAL, OR CLINICAL MEDICAL ADVICE.
The software, visual representations, and voice guidance are designed solely to assist foundational number sense in Grades 1 to 3. The platform:
- Does NOT diagnose or screen for dyscalculia, ADHD, dyslexia, sensory processing disorder (SPD), executive dysfunction, or any developmental disability.
- Does NOT calculate clinical "brain age", IQ, or cognitive capacity scores.
- Does NOT replace individualized educational evaluations (IEE), licensed educational therapy, or medical diagnosis by a qualified pediatrician or clinical psychologist.
2. Pediatric Sensory Safety & Motion Invariants
To support calm focus and avoid sensory overstimulation in elementary-aged children, KineticMath strictly enforces the following safety invariants:
- W3C Photosensitive Epilepsy Defense: Animations use calm, steady motion with zero flashing, strobe effects, or rapid luminance changes.
- Auditory Volume Caps & Soft Nature Hum: All procedural Web Audio stems are bandpass-filtered with zero harsh buzzers, screeching alarms, or jarring failure sounds. Rest breaks feature a quiet bumblebee hum to support natural restful calm.
- Pacing Holds (≥ 1,500ms): The interface enforces minimum tactile holds of 1,500 milliseconds between counting actions to prevent frenetic tapping, button mashing, or impulsive clicking habits.
- Zero Countdown Pressure Clocks: No timed countdown penalty clocks exist during lesson problem-solving.
3. Parental & Guardian Responsibility Covenant
By authorizing a child to use KineticMath Lab, the parent, legal guardian, or authorized educator acknowledges:
- Supervision: You agree to provide appropriate adult supervision during sessions and establish healthy daily screen time boundaries.
- PIN Gate Security: You agree to keep your 4-digit Parent PIN secret from your learner to prevent unauthorized access to curriculum settings or account deletion options.
- Voluntary Participation: All calm break exercises (e.g. eye resting, desk stretches) are entirely voluntary and include seated alternatives and instant skip controls.
4. E-Sign Act Compliance & Executed Record Retention
In compliance with the federal E-SIGN Act (15 U.S.C. § 7001), when a guardian completes onboarding and checks the mandatory acceptance box:
- A tamper-evident cryptographic timestamp (ISO 8601 UTC) and unique Consent Confirmation ID (`km_consent_*`) are generated and recorded.
- A complete, verbatim electronic copy of this Disclaimer, the Children's Privacy Policy, and Terms of Use is immediately emailed to the guardian's designated email address.
- You may view, verify, or download your executed consent certificate at any time via the Parent Hub at /adult.

PORTALKINETIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR EDUCATIONAL PURPOSE, ACCURACY OF MATHEMATICAL CURRICULA, OR UNINTERRUPTED SYSTEM OPERATION. IN NO EVENT SHALL PORTALKINETIC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
